Can I refinance a rental in an LLC?

Yes — entity vesting is standard on DSCR refinances. Here's what the lender needs and what to watch for when moving title.

Yes. Closing a DSCR refinance in an LLC is routine, and many programs prefer it. Because these are business-purpose loans rather than consumer mortgages, entity vesting fits the product rather than complicating it.

What the lender will need

  • Articles of organization and the operating agreement
  • EIN letter
  • Certificate of good standing / status in the property's state
  • A list of members and their ownership percentages
  • A personal guaranty from the principal(s) — expect this on nearly every file

Moving title into the entity

If the property is currently in your personal name, title can generally be transferred into your LLC as part of the refinance, or before it via quitclaim or warranty deed. Coordinate with the title company and your attorney — a sloppy transfer creates title exceptions that stall closing.

Watch two things when transferring: your existing loan's due-on-sale clause, and whether your state charges transfer tax on a deed into an entity you own.

Foreign LLCs

A Wyoming or Delaware LLC holding property in another state usually needs to be registered as a foreign entity in the state where the property sits. Get that registration done early; it is a common last-minute delay.

Insurance has to match

The policy must name the LLC as the insured. If the deed says the entity and the policy says your name, the file stops until it's corrected. Fix it before you're at the closing table.
